Former San Francisco 49ers first-rounder Aldon Smith simply can't stay out of trouble with the law. He was arrested earlier this month on a DUI causing injury, but now some rather disturbing details have emerged from the incident.

Per TMZ Sports, Smith had a Blood Alcohol Level of over .20 before he was arrested. The legal limit in California is just .08. On December 6th San Mateo County police in California booked the ex-49ers star after he had been driving drunk which resulted in a two-car accident. On Monday, prosecutors finally filed charges against him.

According to the files, Smith had an open bottle of alcohol and visible marijuana in the car at the time of the accident. He is facing up to three years in prison if convicted of these charges. Smith was also arrested earlier this year on battery charges in Louisiana.

The 32-year-old finds himself out of the NFL after being cut by the Seattle Seahawks prior to the 2021 season because of the incident in Louisiana. The seventh overall pick by the 49ers in 2011, Smith spent 2020 with the Dallas Cowboys and actually had a pretty solid campaign. He spent a total of three years with San Francisco before taking his talents to the Raiders from 2015-17. He wasn't back in the league until 20′, but considering all the problems he's having, it seems unlikely we see him playing ever again.
