On Wednesday, Los Angeles U.S. District Court Judge Michael W. Fitzgerald made the ruling to refuse to declare a mistrial in the Derrick Rose rape lawsuit. The ruling came about after Rose's attorneys argued that the accuser's lawyers withheld three text messages that helped their case. Judge Fitzgerald stated that the accuser's lawyers failed to share material with the defense but that it was not enough to dismiss the case.

Moving forward, Judge Fitzgerald will inform the jurors that the texts were recently disclosed and will allow the defense team to question the accuser. The accuser's lawyers however have claimed that the texts were in fact shared with the defense but could not prove it.
